Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Forevermore wedding website and related services (the "Service"), operated by Forevermore LLC ("Forevermore," "we," "us," or "our"), 1890 Star Shoot Pkwy, Suite 170 PMB 406, Lexington, KY 40509. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. The Service

Forevermore lets couples build a wedding website and manage RSVPs, a gift registry and cash funds, a photo gallery, a day-of experience, and livestreaming. Features and plans may change over time.

3. Your account

You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

4. Your content and license

You retain ownership of the content you upload, including text, photos, and guest information ("Your Content"). You grant Forevermore a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to operate and provide the Service, including publishing it on your wedding site to the audience you choose. You are responsible for having the rights to the content you upload and for what you publish.

5. Guest information

When you upload guest details such as names, contact information, and RSVP responses, you act as the data controller for that information and Forevermore acts as your processor. You are responsible for having a lawful basis to provide guest information to us and for informing your guests as required by applicable law. See our Privacy Policy.

6. Acceptable use

You agree not to use the Service for anything unlawful; upload content that infringes others' rights or is unlawful, harmful, or objectionable; attempt to breach security or disrupt the Service; misuse others' personal data; or resell the Service without our permission.

7. Payments and billing

Paid plans are sold and processed by our authorized reseller and Merchant of Record, Paddle.com ("Paddle"). Paddle handles payment, invoicing, and applicable taxes, and your purchase is also subject to Paddle's buyer terms. Prices are shown at checkout; we may change prices on a going-forward basis. Subscriptions renew automatically until cancelled.

8. Cancellation and refunds

You may cancel at any time; access continues through the end of your paid period. Refunds are governed by our Refund Policy.

9. Termination

We may suspend or terminate your access if you breach these Terms or to comply with law. You may stop using the Service and delete your account at any time.

10. Intellectual property

The Service, including its software, design, and the Forevermore name and marks, is owned by Forevermore and its licensors. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms.

11. Third-party services

The Service relies on third-party providers for payment, email, and hosting. We are not responsible for third-party services, and your use of them may be subject to their own terms.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Forevermore will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim relating to the Service will not exceed the amount you paid to us (through Paddle) in the twelve months before the claim.

14. Indemnification

You agree to indemnify and hold Forevermore harmless from claims, damages, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

15. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.

16. Dispute resolution and arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration seated in Lexington, Kentucky, administered under the rules of a recognized arbitration body, rather than in court — except that either party may bring a claim in small-claims court or seek injunctive relief for intellectual-property misuse. You and Forevermore each waive the right to a jury trial and to participate in a class action.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the Service means you accept the updated Terms.
